Terms of Service

1. Agreement

By installing FirstTry, you (the customer) agree to these terms. If you do not agree, do not install the application.

2. License Grant

FirstTry is licensed as-is for use by your organization within the scope of your Jira Cloud subscription. You may:

  • Install FirstTry on your Jira Cloud site
  • Use FirstTry to generate compliance reports
  • Export compliance evidence

You may NOT:

  • Reverse engineer, decompile, or disassemble FirstTry
  • Redistribute FirstTry or create derivative works
  • Remove copyright or license notices
  • Use FirstTry for any illegal purpose

3. Limitations of Liability

AS-IS: FirstTry is provided on an "as-is" basis without warranties, express or implied.

NO WARRANTY: We do not warrant that FirstTry will:

  • Be error-free or uninterrupted
  • Meet your specific requirements
  • Comply with all applicable laws (your responsibility)

LIMITATION OF DAMAGES: FirstTry is not liable for:

  • Data loss or corruption
  • Lost profits or business opportunity
  • Indirect, incidental, or consequential damages
  • Damages arising from platform (Atlassian Forge) unavailability

DISCLAIMER: FirstTry is not responsible for Atlassian Forge or Jira Cloud availability, security, or performance. See FORGE_PLATFORM_DEPENDENCY.md.

4. Acceptable Use Policy

You agree NOT to use FirstTry to:

  • Access unauthorized data outside your Jira site
  • Breach other users' privacy or security
  • Conduct illegal activities or violate laws
  • Reverse engineer or attack FirstTry or Atlassian services
  • Bypass security controls or API rate limits

5. Termination

You may terminate: Uninstall FirstTry from your Jira Cloud administration console at any time.

We may terminate: FirstTry may be discontinued or discontinued features may be removed without notice.

6. Indemnification

You agree to defend and indemnify FirstTry against claims arising from:

  • Your use of FirstTry in violation of these terms
  • Your violation of applicable law using FirstTry
  • Your breach of Jira Cloud terms of service

7. Governing Law

These terms are governed by applicable law where FirstTry Solutions is incorporated. Any disputes shall be resolved in courts of competent jurisdiction.

8. Severability

If any provision is unenforceable, the remaining provisions remain in effect.

9. Entire Agreement

These terms, along with PRIVACY_POLICY.md and SECURITY_OVERVIEW.md, constitute the entire agreement between you and FirstTry regarding the application.

10. Changes

We may update these terms at any time. Material changes will be noted in release notes. Your continued use constitutes acceptance.
